Section 79 & 80 Crimes Act | Bestiality

It is against the law to have sexual intercourse with an animal.

This is known as the offence of bestiality, which is contained in sections 79 and 80 of the Crimes Act 1900.

Bestiality refers to the sexual penetration of any animal.

It can result in heavy penalties under the law – the maximum penalty for this offence is imprisonment for 14 years.

You may also be charged with an offence if it is alleged that you attempted to commit bestiality – in these cases, the maximum penalty is 5 years imprisonment.

The Legislation

Section 79 & 80 of the Crimes Act 1900 deals with the offence of ‘Bestiality’ and reads as follows:

79 Bestiality

Any person who commits an act of bestiality with any animal shall be liable to imprisonment for fourteen years.

80 Attempt to commit bestiality

Any person who attempts to commit an act of bestiality with any animal shall be liable to imprisonment for five years.
