District Court Conviction Appeals are appeals from the Local Court to the District Court on the ground that you should not have been found guilty in the Local Court.
These appeals must be filed within 28 days of your Local Court sentencing unless you apply for ‘leave’ (permission) to appeal outside the 28 days which you can do for up to 3 months after your local court sentencing.
The District Court will decide whether to allow you to appeal outside time. At the appeal, the judge will receive the transcript of your local court hearing and any other exhibits tendered during those proceedings.
The judge will go through all of the materials and receive written and/or verbal submissions from each party before deciding whether you are guilty or not guilty.
