Fraud

Fraud is an offence under Section 192E of the Crimes Act 1900 which carries a maximum penalty of 10 years in prison.

To prove the offence, the prosecution must establish:

  1. That by a deception
  2. You acted dishonestly, and
  3. Your actions caused you to obtain a financial advantage, or caused another to suffer a financial disadvantage.

If the prosecution is unable to prove each of those ‘elements’ beyond a reasonable doubt, you must be found not guilty of the offence.
