Contaminating Goods

Contaminating goods is an offence under section 93K of the Crimes Act 1900 which carries a maximum penalty of 10 years in prison

To establish the offence, the prosecution must prove beyond reasonable doubt that you:

  1. Contaminated goods, and
  2. Intended to cause public alarm or anxiety, or to cause economic loss through public awareness of the contamination

Under section 93O, the maximum increases to 25 years in prison where:

  1. The contamination caused death or grievous bodily harm, or
  2. Your intention was to cause death or grievous bodily harm

‘Contaminate’ includes:

Interfering with the goods or making it appear the goods have been interfered with

‘Goods’ includes any substance or article whether or not for human consumption, whether or not incorporated or mixed with other goods, and whether natural or manufactured

‘Economic loss’ includes:

Members of the public not purchasing the goods or similar goods, and steps taken to avoid public alarm or anxiety about the goods or similar goods
