Facilitating Conduct that Corrupts the Betting Outcome of an Event

Facilitating conduct that corrupts the betting outcome of an event is an offence under section 1930 of the Crimes Act 1900, which carries a maximum penalty of 10 years in prison.

To establish the offence, the prosecution must prove beyond reasonable doubt that:

  1. You facilitated conduct that corrupted the betting outcome of an event
  2. You did so knowing or being reckless as to whether your conduct would do this, and
  3. You intended by doing so to obtain a financial advantage, or cause a financial disadvantage, in relation to the event.

‘Conduct’ means any act or omission to perform an act.

Conduct ‘corrupts the betting outcome of an event’ if:

  1. It affects, or would be likely to affect, the outcome of the event, and
  2. It is contrary to the standards of integrity that a reasonable person would expect of someone in your position

‘Betting’ includes placing, accepting or withdrawing a bet, as well as causing a bet to be placed, accepted or withdrawn.

To ‘facilitate’ means to:

  1. Offer to engage in conduct
  2. Encourage another person to engage in conduct, or
  3. Enter into an agreement about conduct.

An ‘agreement’ includes an arrangement.

You were reckless if you foresaw the possibility that your conduct would facilitate corrupting the betting outcome of the event, but went ahead with your actions regardless.

Duress is a defence to the charge.
