Penalty for Dishonestly Destroying or Damaging Property | Section 197 Crimes Act NSW

The maximum penalty for the offence of “dishonestly destroying or damaging property” is 7 years in prison.

According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:

  • Intensive Correction Order: 50%
  • Prison: 25%
  • Conditional Release Order with Conviction: 12.5%
  • Community Correction Order: 12.5%

The average prison sentence for the offence is 15 months imprisonment, and the average non-parole period (or minimum prison term that must be served) is 9 months in prison.
