Penalty for Promoting or Engaging in Child Prostitution | Section 91D Crimes Act NSW

The maximum penalty for the offence of “promoting or engaging in child prostitution” is 10 years in prison or 14 years where the child was under the age of 14.

According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:

  • Prison: 75%
  • Community Correction Order: 17%
  • Intensive Correction Order: 8%

The average prison sentence for the offence is 3 years imprisonment, and the average non-parole period (or minimum prison term that must be served) is 13.5 months in prison.
