The maximum penalty for the offence of “unauthorised access to restricted data” is 2 years in prison.
According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:
- Conditional Release Order without Conviction: 34.4%
- Community Correction Order: 31.3%
- Conditional Release Order with Conviction: 18.8%
- Fine Only: 9.4%
- Section 10A No Other Penalty: 6.3%
