The maximum penalty for the offence of “furious driving” is 2 years in prison.

According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:

  • Imprisonment: 21.9%
  • Community Correction Order: 32.8%
  • Intensive Correction Order: 28.1%
  • Conditional Release Order without Conviction: 9.4%
  • Conditional Release Order with Conviction: 4.7%
  • Fine Only: 3.1%

The average prison sentence for the offence is 14.14 months imprisonment, and the average non-parole period (or minimum prison term that must be served) is 6.5 months in prison.
