Penalty for Stealing Trees | Section 140 Crimes Act NSW

The maximum penalty for the offence of “stealing trees” is 5 years in prison.

According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:

  • Conditional Release Order without Conviction: 30%
  • Fine Only: 40%
  • Conditional Release Order with Conviction: 20%
  • Prison:  10%

The average prison sentence for the offence is 2 months imprisonment.
